The U.S. Court of Appeals for the Federal Circuit in Washington, D.C., has affirmed a key ruling secured by Alavi Anaipakos in a “bet-the-industry” lawsuit that threatened the firm’s clients and other major producers of poultry products.
The May 4 decision affirms an earlier district court ruling in favor of Alavi Anaipakos’ clients at Arkansas-based Safe Foods Corp., one of the nation’s leading food safety providers.
“We are grateful that the appeals court agreed that the accusations against our clients were unsupported by the facts,” says Amir Alavi, who led the firm’s successful work on behalf of Safe Foods. “A lot of people will sit down to dinner tonight knowing that the law protects companies that do things the right way to make sure their food is safe.”
Mr. Alavi worked alongside fellow firm attorneys Scott Clark and Steve Jugle to defend the company in a patent infringement lawsuit filed in Arkansas by California-based competitor Enviro Tech Chemical Services Inc.
Safe Foods was among several companies accused of infringing an Enviro Tech patent covering technology for sanitizing poultry products. Alavi Anaipakos immediately attacked the patent’s validity in a Markman hearing before the U.S. District Court for the Eastern District of Arkansas.
After the court invalidated the Enviro Tech patent following successful arguments presented by Mr. Alavi, Mr. Clark, and Mr. Jugle during the 2022 Markman hearing over whether the patent was valid, Enviro Tech appealed to the Federal Circuit.
